Cannabis seed legalisation is an often overlooked part in the big picture of South Africa's growing movement. The constitutional court ruling that decriminalized dagga did not take into consideration several practicalities. One of these remains a lingering question, are cannabis seeds legal?
Now if you were to simply follow the spirit of the court's ruling, the answer would be a simple "Yes, weed seeds are legal". Things are however unfortunately not that simple due to the ruling have somewhat of a contradiction. 2018's Constitutional courts verdict is very clear about it being legal for adults to privately grow and consume cannabis, but is just as clear about not being allowed to sell or trade any part of the plant. So now how are you going to practice this new found right when you are prevented from accessing the seeds to that right?! Effectively creating a cannabis seed legalisation crisis.
This question is one of the many obstacles being faced by the local cannabis industry. The Cheeba Cannabis Academy and Cannabis Trade Association recently hosted a webinar to identify the most pressing of these issues. Jordyn Murcia from Green Smoke Room Seeds was one of the key presenters. He discussed some of the finer legal points and highlighted the work he has already invested to allow the trade of both local and international genetics. Not just for themselves, but for all local cannabis seed traders.
